Bundesnachrichtendienst (BND) - Adolf Eichmann
In the year 2008, I asked the Federal Intelligence agency BND to release its files on "Eichmann in Argentina", "German-Israeli cooperation until the year 1960 on nuclear matters" and "research of German citizens on topics related to armaments after Second World War in Argentina. The BND felt safe, the German Freedom of Informacion Act (Informationsfreiheitsgesetz) do not include intelligence agencies. So, BND wrote me: Yes we have 4500 pages but we deny completly the access to these files. I filed a lawsuit before the Federal Administrative Court against BND, based on the Federal Archives Act (Bundesarchivgesetz).
Already on 19 March, 1958, the BND told that Eichmann was living in Argentina under the name of Clemens to the CIA, not to the German public attorney who had issued the arrest warrant against the war criminal. In a meeting on May 5th, 2008, representatives of the Legal Department of Bundeskanzleramt promised me to release all files about Eichmann and nuclear collaboration with Israel. But nothing happend. First, BND argued with the "personality rights" of their former agents that must be protected, then they said that it had received 3.564 pages (before he admitted 4.500 pages) about “Eichmann in Argentina” from a “foreign intelligence agency” and that this foreign agency wants to keep classified these documents for ever. Obviously, they referred to Mossad.
In April 2010, the court pronounced a sentence and declared illegal the classification.Download [PDF] The court ordered to present or another detailled declaration of Bundeskanzleramt for classification or the requested files until end of August. On September 1st, 2010 I could see in the court in Leipzig, together with my lawyer Reiner Geulen, what BND presented: another very similar declaration for classification of Bundeskanzleramt and some files, nearly totally white or totally black. Download [PDF] According to what I could see, all the BND activities where directed to possible statements of Eichmann in his process in Jerusalem. Obviously, the government of Mr. Konrad Adenauer was afraid that Eichmann talked about his accomplices in the Holocaust who made career in the government of the young state in Bonn: ministers and above all: Hans Globke, author of the Nuremberg Race Laws and right hand of Adenauer in Bundeskanzleramt and therefore supervisor of BND.
In February 2012 the Federal Administrative Court in Leipzig ruled again. The decision of the Federal government was illegal; the records must be completely submitted. They are important historical documents. But the German government presented another declaration, and this time, the Court accepted. So, about 100 pages will be secret for ever.
